Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the LotWize platform operated by Sanaf AI Solutions, LLC (“LotWize,” “we,” “us,” or “our”), including our website at lotwize.com and our application at https://app.lotwize.com(collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of your homeowners association or property management company to use the Service. By using LotWize, you represent that you have the authority to bind your organization to these Terms.

3. The Service

LotWize provides AI-powered HOA management tools including, but not limited to: AI Document Brain (CC&R intelligence), AI Violation Manager, AI Resident Chatbot, AI Architectural Review, dues collection and payment processing, meeting management, board voting, and homeowner portal functionality.

AI-generated content (violation notices, chatbot responses, board packets) is provided as a starting point for review. You are responsible for reviewing and approving all AI-generated content before it is sent to homeowners or used in any official capacity. LotWize does not provide legal advice.

4. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized use of your account at support@lotwize.com.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable HOA law
• Upload content that is defamatory, abusive, or violates any third party's privacy rights
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Resell or sublicense the Service without our written permission

6. Your data

You retain ownership of all data, documents, and content you upload to LotWize (“Your Data”). By uploading Your Data, you grant LotWize a limited, non-exclusive license to process, store, and transmit Your Data solely to provide the Service.

We do not use Your Data to train AI models for any purpose other than operating your account. You can export all Your Data at any time. See our Privacy Policy for details.

7. Payment and subscriptions

Paid plans are billed monthly or annually via Stripe. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period — you retain full access until then.

Free trial: We offer a 14-day free trial for new accounts. A valid credit card is required to start the trial. If you do not cancel before the trial ends, your card will be charged for the selected plan.

Refunds: We evaluate refund requests on a case-by-case basis. Contact support@lotwize.com within 7 days of a charge you believe was made in error.

8. Intellectual property

LotWize and all related technology, software, designs, and content are owned by Sanaf AI Solutions, LLC and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written permission.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR LEGALLY SUFFICIENT FOR YOUR JURISDICTION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOTWIZE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless LotWize and its officers, directors, employees, and agents from any claim, liability, or expense arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

13. Governing law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date and notify active users by email of material changes. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
